1. Acceptance of Terms

By clicking "I agree to the Terms of Use and Disclaimer," accessing the FixMyBalanceSheet diagnostic tool, or submitting any information through this platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and the accompanying Disclaimer and Privacy Policy, all of which are incorporated herein by reference.

If you are using this tool on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

FixMyBalanceSheet is an automated, rule-based balance sheet structural diagnostic tool. The tool accepts user-submitted financial figures and produces a scored assessment of balance sheet integrity across six weighted categories. The service is currently offered as a beta product and may change at any time without notice.

The tool does not connect to, access, or retrieve data from any accounting software, financial institution, or external data source. All analysis is based solely on the figures you enter.

3. Permitted Use

You may use FixMyBalanceSheet for lawful, personal, or internal business purposes only. You agree not to:

— Use the tool for any unlawful purpose or in violation of any applicable law
— Submit false, misleading, or fraudulent financial data
— Attempt to reverse engineer, copy, or replicate the scoring algorithm
— Use automated scripts, bots, or scrapers to access the service
— Resell, redistribute, or commercially exploit the tool's outputs without written permission
— Use outputs of this tool in any audit report, certified financial statement, or regulatory filing

4. No Professional Relationship

Use of this tool does not create any attorney-client, accountant-client, advisor-client, fiduciary, or other professional relationship between you and Consulting Opportunity Holdings LLC or any of its personnel. No engagement letter is formed. No duty of care is established.

5. Informational Purpose Only

All outputs — including scores, ratings, flags, observations, and reports — are for informational and educational purposes only. They are not financial advice, accounting advice, tax advice, legal advice, or any professional opinion. Results should never be used as the sole or primary basis for any business, financial, or legal decision.

You are solely responsible for all decisions made in reliance on or in connection with the use of this tool.

6. Intellectual Property

The FixMyBalanceSheet platform, including but not limited to the scoring algorithm, rule engine logic, design, interface, content, and branding, is the intellectual property of Consulting Opportunity Holdings LLC. You may not copy, reproduce, distribute, or create derivative works without express written consent.

Reports delivered to your email address are for your personal or internal business use only and may not be published, sold, or redistributed.

7. Disclaimer of Warranties

The tool is provided on an "as is" and "as available" basis. Consulting Opportunity Holdings LLC makes no warranties, express or implied, including but not limited to warranties of accuracy, completeness, reliability, merchantability, or fitness for a particular purpose. We do not warrant that the tool will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, Consulting Opportunity Holdings LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the tool, including any reliance on outputs generated by the tool. This limitation applies regardless of the legal theory asserted and even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless Consulting Opportunity Holdings LLC and its affiliates, officers, directors, employees, and agents from any claim, liability, loss, damage, or expense (including reasonable attorneys' fees) arising out of your use of the tool, violation of these Terms, or any misrepresentation of financial data submitted through the platform.

10. Third-Party Service Providers

FixMyBalanceSheet uses the following third-party service providers in the delivery of its services:

EmailJS — Used to transmit diagnostic report emails to users. Email addresses and report content are processed by EmailJS in accordance with their privacy policy available at emailjs.com.

Vercel Inc. — Used to host and serve the FixMyBalanceSheet platform. Vercel's infrastructure may process user request data in accordance with their privacy policy available at vercel.com.

We do not control the practices of these providers and encourage you to review their respective policies.

11. Beta Product Terms

FixMyBalanceSheet is currently in beta. Features, scoring logic, pricing, and availability may change at any time without prior notice. Beta users accept that the product may contain errors or incomplete functionality. Feedback provided by users during the beta period may be incorporated into product improvements without obligation or compensation.

12. Termination

We reserve the right to suspend or terminate access to FixMyBalanceSheet at any time, with or without cause, with or without notice. Upon termination, all rights granted to you under these Terms will immediately cease.

13. Governing Law and Dispute Resolution

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the tool shall be resolved exclusively in the state or federal courts of Texas. You hereby consent to the personal jurisdiction of such courts.

14. Modifications

We may update these Terms at any time. Updated Terms will be posted at this URL with a revised effective date and version number. Continued use of the tool after posting constitutes acceptance of the revised Terms.
